Llama Lease Agreement

Please read the full agreement carefully, then complete and sign the form below. Receipt of deposit constitutes acknowledgement and acceptance of all terms.

Helena Backcountry Llamas — Llama Lease Agreement

Agreement Overview

Kevin Brown dba Helena Backcountry Llamas ("Lessor") agrees to lease to the Customer ("Lessee") llama(s) and equipment, llama tack and gear upon the following terms and conditions.

Upon taking possession of these llama(s), I understand and agree to assume full liability and responsibility for the animal(s). I will be my own guide and provide food and water in sufficient quantity so as to return the animal(s) in the same or better condition as when I received them.

I completely understand and agree I am responsible for the llama(s) well-being, the equipment, tack, and any borrowed trailers I lease that are in my possession. Lessor or its designated agent shall be the sole judge of condition.

In the event that the animal(s) are injured or cannot be returned in the same condition as when I received them, I shall remit a sum of six thousand dollars ($6,000.00) for each animal in said condition. In the event a llama is lost, I will reimburse Lessor $300 per diem until the llama is found or loss equals six thousand dollars ($6,000). For each dead, totally disabled, or missing animal I agree to pay the sum of six thousand dollars ($6,000).

Pack Llamas, Equipment, Tack & Trailers

All rental llamas include halter and lead rope, saddle with pad(s), panniers, white pannier boxes, square bucket with lids, picket stake and picket rope for each llama. Two llama brushes, two scales, and llama feed will also be provided for the rental llama string.

In the event any llamas, equipment, tack, or trailers provided, borrowed, or leased with the llamas are lost, damaged, or stolen, the Customer agrees to pay out-of-pocket to replace said items at the following rates:

Booking, Cancellation & Refund Policy

Deposit: To reserve your llamas, we require a deposit of 50% of the total trip cost at the time of booking, paid via Venmo to @helenallamas. This deposit secures your dates and allows us to begin arrangements for your adventure.

Final Payment: The remaining balance is due 60 days before your trip's departure date. We will send a reminder as that date approaches.

60+ Days in Advance

Full refund minus a $100 administrative fee.

46–59 Days in Advance

50% refund of the total trip cost.

45 Days or Less

Trip cost is non-refundable. Travel insurance strongly recommended.

For your peace of mind, we recommend considering travel insurance from providers such as World Nomads, Allianz, or Travel Guard to cover unexpected cancellations, medical needs, and more.

Release of Liability, Responsibility & Acknowledgement of Risk

In consideration of participating in the Activity, I waive and release my rights to file a claim or lawsuit against Kevin Brown dba Helena Backcountry Llamas, its employees, agents, volunteers, successors, assigns, and the State of Montana from all claims for any liability, injury, loss, or damage resulting from the use of the llama(s) by me or members of my party.

I understand fully the responsibility associated with the use of the llama(s) and assume total responsibility for the terms and conditions of this Llama Lease Agreement. I shall pay any claims or legal fees connected with the use of the llama(s) under the terms of this lease. I waive and release my rights to any claim for negligence or lack of ordinary care that could be filed against Kevin Brown dba Helena Backcountry Llamas for any risks inherent in the participation of the Activity.

I acknowledge that hiking with llamas, hiking, fishing, hunting, and mountain and/or backcountry travel has inherent risks, hazards and dangers that sometimes cannot be eliminated, particularly in a remote wilderness or backcountry setting. Risks inherent to animal activities include but are not limited to:

  • The propensity of an animal to behave in ways that may result in injury, harm, or death to persons on or around them;
  • The unpredictability of an animal's reaction to sounds, sudden movement, medication, and unfamiliar objects, persons, or other animals;
  • Hazards such as surface and subsurface ground conditions; collisions with other animals or objects;
  • Variations in terrain including creeks, water, bridges, rocks, cliffs, stumps, forest growth, debris, and other obstacles whether obvious or not;
  • Hiking in rugged country; encounters with wildlife, animals, and insects; temperature extremes;
  • Inclement weather conditions and the unavailability of immediate medical attention or evacuation;
  • The risk of handling firearms and being in the vicinity of others with firearms in their possession.
Voluntary Participation

I acknowledge that I am voluntarily participating in the activities of Helena Backcountry Llamas and the use of their property, animals, and facilities. I am aware that medical services or facilities may not be readily available or accessible during some or all of the time. I hereby accept and assume full responsibility for any and all risks of illness, injury, or death arising from the activities, due to the negligence (but not the reckless, willful, or fraudulent conduct) of Kevin Brown dba Helena Backcountry Llamas, their employees, or their llamas.

Release and Covenant Not to Sue

As consideration for being permitted to participate in the activities associated with Helena Backcountry Llamas, I hereby agree that neither I, nor any of my heirs, personal or legal representatives, or family members will bring suit or make a claim for illness, injury, or death resulting from the negligence (but not reckless, willful, or fraudulent conduct) of Kevin Brown dba Helena Backcountry Llamas, their employees, or the supplier of the facilities and equipment I will use.

I hereby release Kevin Brown dba Helena Backcountry Llamas, their employees, and the suppliers of facilities and equipment from and against any and all liability arising out of, or in any way connected with, my participation in activities with Helena Backcountry Llamas, including any liability for negligence (but not reckless, willful, or fraudulent conduct).

Controlling Law

Any controversy or claim arising out of or relating to this Agreement or the performance hereunder, including without limitation any claim related to illness, injury, or death, shall be governed by Montana law. Any lawsuit filed as a result of participation with Helena Backcountry Llamas shall be filed in the appropriate court in the State of Montana.

Knowing and Voluntary Execution

I have carefully read this agreement and understand its contents. I am aware that this is a release of liability and that receipt of deposit and/or final payment is acknowledgement that I have read and accept the lease agreement, deposit, payment schedule, cancellation and refund policy, responsibility, and acknowledgement of risk clauses.
