Llama Rental Agreement
Helena Backcountry Llamas, LLC (“Lessor”) agrees to lease to the Customer (“Lessee”) llama(s) and equipment, tack and trailer upon the following terms and conditions:
Upon taking possession of these llama(s), I understand and agree to assume full liability and responsibility for the animal(s). I will be my own guide and provide food and water in sufficient quantity so as to return the animal(s) in the same or better condition as when I received them.
I completely understand and agree I’m responsible for the llama(s) well-being, the equipment, tack and trailers I lease and are in my possessions. Lessor or its designated agent shall be the sole judge of condition.
In the event that the animal(s) are injured or cannot be returned in the same condition as when I received then, I shall remit a sum of five thousand dollars ($5000.00) for each animal in said condition. In the event a llama is lost I will reimburse Lessor a $300 per diem until the Llama is found or loss equals six thousand dollars ($6,000). For each dead, totally disabled or missing animal I agree to pay the sum of six thousand dollars ($6,000).
Pack Llamas, Equipment, Tack, Trailers
All rental llamas include halter and lead rope, saddle with pad(s), panniers, square buckets with lids (4 per pannier set), picket stake and picket rope for each llama. A llama brush, scale, and llama feed will also be provided for the rental llama string.
In the event any llamas, equipment, tack or trailers provided or leased with the llamas is lost, damaged or stolen, the Customer agrees to pay out-of-pocket to replace said llamas, equipment, tack, and/or trailer at the following rates:

Deposit, Payment Schedule, Cancellation & Refund Policy
All reservation are taken on a first come first served basis. A 50% non-refundable deposit is required and you will receive an email confirmation of receipt. Receipt of a deposit and final payment is acknowledgement that I have read, understand and accept the Lease Agreement, the Deposit, Payment Schedule, Cancellation and Refund Policy, and acknowledgement of risk clauses.
Final payment is due 30 days prior to departure.
There is no refund for any unused portion of the package. If you leave a trip early for any reason, the full amount will be applied and no refund will be made. If you rent llamas and return early you will not be refunded or credited any money. Itinerary changes - dates, number of llamas to be rented and trailers - are conditional based on availability. Non-payment of balance will be considered a cancellation and the deposit will be forfeited.
No refund will be given for rental cancellation due to circumstances beyond the Lessor control, including campsite availability, snowpack, river crossings, wildlife, park or land closures, forest fires, travel advisories, political turmoil, or environmental disasters for your chosen destination.
Itinerary changes - dates, number of llamas to be rented and a trailer - are conditional based on availability. In the event that Helena Backcountry Llamas LLC has to cancel a reservation for any reason, a full refund will be given.

Release of Liability Waiver
Responsibility & Acknowledgement of Risk
In consideration of participating in the Activity, I waive and release my rights to file a claim or lawsuit against Helena Backcountry Llamas, LLC, employees, agents, volunteers, successors, assigns, the State of Montana, the State of Idaho, and the State of Wyoming, if any, from all claims for any liability, injury, loss, or damage resulting from the use of the llama(s) by me or members of my party. I understand fully the responsibility associated with the use of the llama(s) and assume total responsibility for the terms and conditions of this Llama Lease Agreement. I shall pay any claims or legal fees connected with the use of the llama(s) under the terms of this lease. I waive and release my rights to any claim for negligence or lack of ordinary care that could be filed against Helena Backcountry Llamas, LLC for any risks inherent in the participation of the Activity. I agree to pay the full amount of this lease and additional charges if due to extension of the lease period. I also agree to pay any transportation charges.
I acknowledge that hiking with llamas, horseback riding, hiking, fishing, hunting, boating, kayaking, paddle boarding, mountain climbing, and mountain and/or backcountry travel has inherent risks, hazards and dangers for anyone and sometimes cannot be eliminated, particularly in a remote wilderness, backcountry setting.
Risks inherent to animal activities means dangers or conditions that are an integral part of the animal activities, including but not limited to:

the propensity of an animal to behave in ways that may result in injury, harm or death to persons on or around them;

the unpredictability of an animals reaction to such things as medication; sounds; sudden movement; and unfamiliar objects, persons or other animals;

hazards, such as surface and subsurface ground conditions;

collisions with other animals or objects;
-
the potential for another participant to not maintain control over the animal or to not act within the person’s ability, such as failing to maintain control over the animal or not acting within his or her ability. I may encounter variations in terrain that are my responsibility and I assume these risks including creeks, water, bridges, travel roads, wild things, stumps, forest growth, debris, rocks and cliffs, and other obstacles whether they are obvious or not obvious, man made or natural;

hiking in rugged country; encounters with wildlife, animals, and insects; temperature extremes;

inclement weather conditions and the unavailability of immediate medical attention or evacuation;

the risk of handling firearms and in the vicinity of others with firearms in their possession.
Voluntary Participation
I acknowledge that I have voluntarily participate in the activities of Helena Backcountry Llamas, LLC and the use of their property, animals, and, if any, facilities. I am voluntarily visiting and participating in the activities with Helena Backcountry Llamas, LLC llamas. I am also aware that medical services or facilities may not be readily available or accessible during some or all of the time. I hereby accept and assume full responsibility for any an all risks of illness, injury, or death and due to the negligence (but not the reckless, willful, or fraudulent conduct) of Helena Backcountry Llamas, LLC, their affiliated agencies, their employees, their llamas or other agencies known or unknown.
Release and Covenant Not To Sue
As consideration for being permitted to visit and participate in the activities associated with Helena Backcountry Llamas, LLC I hereby agree that neither I, nor any of my heirs, personal or legal representatives, or family members will bring suit or make a claim for illness, injury or death resulting from the negligence (but not reckless, willful, or fraudulent conduct) of Helena Backcountry Llamas, LLC, their affiliated agencies, their employees, and the supplier of the facilities and equipment I will use during my visit with Helena Backcountry Llamas, LLC
I hereby release Helena Backcountry Llamas, LLC, their affiliated agencies, their employees, and the supplier of the facilities and equipment I will use during my visit Helena Backcountry Llamas, LLC from and against any and all liability arising out of, or in any way connected with, my visit with Helena Backcountry Llamas, LLC, including any liability for negligence (but not reckless, willful, or fraudulent conduct).
Controlling Law
Any controversy or claim arising out of or relating to this Agreement or the performance hereunder, including without limitation any claim related to the illness, injury or death, shall be governed by Montana law. Any lawsuit filed as a result of my visit with Helena Backcountry Llamas, LLC shall be filed in federal court in Billings, Montana.
Knowing and Voluntary Execution
I have carefully read this agreement and understand its contents. I am aware that this is a release of liability and that receipt of deposit and/or final payment is acknowledgement that I have read and accept the lease agreement, deposit, payment dchedule, cancellation and refund policy, responsibility, and acknowledgement of risk clauses.
